TERMS AND CONDITIONS OF USE

These Terms and Conditions of Use ("Terms" or "Terms and Conditions") govern your access to and use of the websites, applications, and digital platforms operated or made available by Wildlife Survival Alliance Foundation India (Formerly Turtle Survival Alliance Foundation India) ("WSAFI", "WSA", "Foundation", "we", "us", or "our"), including indianturtles.org, wildlifesurvival.org, the KURMA application, and any other websites, webpages, applications, digital tools, forms, content, features, services, and resources operated or made available by WSAFI (collectively, the "Website and Platforms").

By accessing, browsing, downloading, registering on, submitting information to, or otherwise using any part of the Website and Platforms, you acknowledge that you have read, understood, and agree to be bound by these Terms and Conditions. Your use of the Website and Platforms is also subject to WSAFI's policies, guidelines, notices, or terms that may be published or made available from time to time. These policies and terms shall be read together and form part of the terms governing your use of the Website and Platforms.

If you do not agree with any provision of these Terms and Conditions or any applicable policy, you must discontinue accessing and using the Website and Platforms. Continued use of the Website and Platforms following the publication or notification of any changes to these Terms or applicable policies will constitute your acceptance of those changes.

1. Acceptance and Applicability

These Terms apply to all visitors, users, donors, volunteers, applicants, contributors, researchers, partners, and other persons accessing or using the Website. Certain sections or services of the Website may be subject to additional terms, guidelines, rules, or conditions. Such additional terms shall form part of these Terms when applicable. If there is a conflict between these Terms and a specific policy or terms applicable to a particular service, the specific terms shall prevail to the extent of that conflict. We reserve the right to modify these Terms from time to time. The updated version will be published on the Website with the revised "Last Updated" date. Your continued use of the Website after any modification constitutes your acceptance of the revised Terms.

2. Eligibility to Use the Website

The Website is intended for users who are legally capable of entering into agreements under applicable law. If you are accessing the Website or submitting information on behalf of an organization, institution, company, or other legal entity, you represent that you have the authority to act on behalf of that entity. You may use the Website for lawful purposes, including: i) Accessing information relating to wildlife, biodiversity, conservation, research, education, and environmental awareness. ii) Learning about the Foundation's programmes and activities iii) Making legitimate donations iv) Applying for volunteering, internships, employment, fellowships, or other opportunities v) Participating in campaigns, events, educational programmes, or citizen-science activities vi) Submitting legitimate wildlife observations or conservation-related information where such facilities are available vii) Accessing publicly available publications, reports, photographs, educational resources, and other materials for permitted purposes. You must use the Website responsibly and in accordance with all applicable laws.

4. Prohibited Activities

You must not use the Website to: i)Violate any applicable law, regulation, rule, order, or governmental requirement ii) Attempt to gain unauthorized access to the Website, servers, databases, accounts, systems, or networks iii) Introduce viruses, malware, ransomware, spyware, worms, malicious code, or other harmful technologies iv) Interfere with, disrupt, overload, or damage the Website or its infrastructure v) Circumvent security mechanisms, access controls, authentication systems, or other protective measures vi) Use automated tools, bots, crawlers, spiders, scraping software, or similar technologies to collect or extract information without prior written authorization vii) Impersonate another individual, organization, employee, volunteer, partner, government authority, or other entity viii) Submit false, misleading, fraudulent, defamatory, unlawful, abusive, or malicious information ix) Use the Website to facilitate wildlife trafficking, illegal wildlife trade, poaching, hunting, collection, capture, possession, transportation, or sale of wildlife or wildlife products x) Use information obtained through the Website to locate, capture, collect, disturb, harass, exploit, or otherwise harm wildlife or sensitive habitats xi) Upload content that infringes copyright, trademark, privacy, publicity, or other rights of another person xii) Attempt to obtain personal information belonging to other users xiii) Use the Website for unauthorized commercial solicitation, advertising, spam, or promotional activities xiv) Misrepresent any relationship or affiliation with the Foundation xv) Use the Website in a manner that could damage the reputation, credibility, operations, or legitimate interests of the Foundation.

5. Website Content and Information

The Website may contain information concerning wildlife species, habitats, conservation activities, research findings, field observations, scientific studies, educational materials, publications, photographs, videos, maps, and other conservation-related information. Although we make reasonable efforts to ensure that information published on the Website is accurate and current, we do not guarantee that all information will always be complete, accurate, current, or error-free. Scientific information may change as new research, observations, methodologies, or evidence become available. Information published on the Website should not be treated as a substitute for professional scientific, veterinary, legal, medical, or governmental advice where such advice is required. We reserve the right to correct, modify, update, remove, or discontinue any content without prior notice.

6. Wildlife Sighting and Citizen-Science Information

Where the Website permits users to submit wildlife sightings, photographs, videos, locations, observations, or other citizen-science information, users must make reasonable efforts to ensure that the information submitted is accurate. Users must not deliberately submit false, fabricated, misleading, or manipulated wildlife records. Submission of a wildlife sighting does not guarantee that the Foundation will verify, publish, respond to, or act upon the information. The Foundation may review, verify, classify, analyse, store, use, or share submitted information for legitimate conservation, scientific, educational, research, monitoring, reporting, or management purposes. Sensitive information concerning threatened species, nesting locations, breeding sites, roosting sites, dens, or other vulnerable wildlife locations may be withheld, generalized, restricted, or otherwise protected where necessary to reduce the risk of disturbance, exploitation, poaching, or illegal wildlife trade. Users must not approach, chase, capture, handle, feed, disturb, or otherwise interfere with wildlife solely for the purpose of obtaining photographs or submitting a sighting.

7. Wildlife Rescue and Emergency Information

Where the Website provides information concerning wildlife rescue, rehabilitation, or reporting, such information is provided for general guidance. Submission of a rescue request through the Website does not constitute an emergency service or guarantee that the Foundation will be able to respond. Response times may depend upon location, availability of personnel, wildlife department permissions, weather, accessibility, species involved, and the nature of the incident. Users must not attempt to capture, restrain, transport, treat, relocate, or otherwise handle wild animals unless legally authorized and appropriately trained. Where required, wildlife emergencies should also be reported to the appropriate government forest/wildlife authorities or other competent authorities. The Foundation shall not be responsible for injury, loss, damage, or other consequences resulting from unauthorized attempts by users to rescue, handle, capture, or relocate wildlife.

8. Donations and Contributions

Donations may be subject to applicable Indian laws, regulatory requirements, tax provisions, and the Foundation's internal policies. Donation receipts, acknowledgements, and applicable tax documentation shall be issued in accordance with applicable law and the Foundation's procedures. Eligibility for any tax deduction or benefit shall depend upon applicable law and the donor's individual circumstances. The Foundation may decline, suspend, investigate, or return a donation where required by law, regulatory requirements, banking/payment requirements, or internal compliance procedures. Donations made through third-party payment gateways may also be subject to the terms and privacy policies of those payment providers.

9. Donations, Refunds and Payment Issues

The Website may provide facilities for individuals, institutions, companies, or other entities to make donations or financial contributions. By making a donation, you confirm that i)The information provided by you is accurate ii)You are legally entitled to use the payment method used iii) The funds are not derived from unlawful activities iv) You are making the donation voluntarily.

Donations are generally voluntary contributions and are not purchases of goods or services. WSAFI does not accept returns or refund amounts for any donations made either one time or regular.

By making an online donation to Wildlife Survival Alliance Foundation India you agree to provide complete, accurate, authentic, and truthful information during the donation process. WSAFI reserves the right to verify and validate the information and other details provided by you at any time. If, upon verification, any information is found to be false, inaccurate, incomplete, or misleading, whether wholly or partly, WSAFI reserves the right, at its sole discretion and subject to applicable law, to reject, suspend, or return the donation.

If you believe that an error has been made while making an online donation, including an error in the donation amount, donation purpose, donor details, or any other transaction parameter, you should notify WSAFI as soon as possible and preferably within 3 working days of the transaction by writing to [wsa.info@wildlifesurvival.org]. WSAFI will make reasonable efforts to review and rectify the error wherever technically and operationally possible. However, correction of a transaction cannot be guaranteed where the transaction has already been processed, settled, or is subject to restrictions imposed by the payment gateway, bank, or applicable law.

The Foundation shall not be responsible for delays caused by banks, payment gateways, card networks, telecommunications providers, or other third parties.

Upon completion of an online donation transaction, you will receive a confirmation indicating whether the transaction has been successfully processed or has failed. A successful payment confirmation does not necessarily constitute final acceptance of the donation if the transaction is subsequently identified as fraudulent, unauthorized, non-compliant, or otherwise subject to verification under applicable law or WSAFI's internal policies.

Once an online donation has been successfully processed and accepted through the applicable payment gateway, cancellation or refund requests will generally not be entertained, except where required by applicable law or in circumstances such as an unauthorized or fraudulent transaction, duplicate payment, technical error, or other exceptional circumstances identified and verified by WSAFI. Any refund request will be considered in accordance with WSAFI's Donation Refund Policy, the terms applicable to the relevant payment gateway, and applicable laws and regulations. WSAFI reserves the right to request supporting information or documentation before processing any refund.

Only Indian donors are eligible for a tax exemption certificate under Section 80G of the Income Tax Act, 1961, subject to the applicable provisions and requirements of law. Where applicable, the tax exemption certificate or donation receipt will be issued and sent to the registered email address and/or postal address provided by the donor during the online donation process. Donors are responsible for ensuring that the name, address, PAN, email address, and other information submitted during the donation process are accurate and complete. WSAFI shall not be responsible for delays or inability to issue or deliver the applicable certificate or receipt arising from incorrect or incomplete information provided by the donor.

For questions, concerns, transaction-related issues, correction requests, refund requests, recurring donation cancellations, or any other information relating to online donations, please contact wsa.info@wildlifesurvival.org. Donors are encouraged to retain their transaction reference number, payment confirmation, and other relevant details when contacting the Foundation regarding a donation.

10. Volunteer, Internship, Fellowship and Career Applications

The Website may provide opportunities to apply for volunteering, internships, fellowships, employment, consultancy, research positions, or other opportunities. Submission of an application does not create an employment, contractual, partnership, or other legal relationship between the applicant and the Foundation. The Foundation does not guarantee that every applicant will receive a response, interview, placement, internship, volunteer opportunity, or employment offer. Applicants must provide accurate and complete information. Submission of false qualifications, documents, experience, references, or other information may result in disqualification. Selection shall be based on applicable eligibility requirements, organizational needs, qualifications, experience, availability, and other relevant criteria.

11. User-Submitted Content

Users may have the opportunity to submit photographs, videos, text, reports, observations, documents, comments, testimonials, artwork, or other materials ("User Content").

By submitting User Content, you represent and warrant that: i)You have the necessary rights and permissions to submit the material ii) The material does not infringe the rights of any third party iii) The material is not unlawful, defamatory, fraudulent, obscene, abusive, or misleading iv) Where identifiable individuals appear in the content, you have obtained any permissions required by applicable law.

Subject to applicable law and our Privacy Policy, you grant the Foundation a non-exclusive, royalty-free, worldwide license to reproduce, publish, display, adapt, archive, distribute, communicate, and otherwise use the User Content for legitimate conservation, research, educational, awareness, reporting, fundraising, and communication purposes. Where appropriate, the Foundation may provide attribution to the contributor. The Foundation reserves the right to refuse, edit, restrict, or remove User Content at its discretion.

12. Photographs, Videos and Field Documentation

Photographs and videos published on the Website may have been obtained by the Foundation, its staff, researchers, partners, volunteers, photographers, supporters, or other authorized contributors. Photographs and videos must not be copied, modified, reproduced, commercially exploited, or redistributed without appropriate permission. Users must not use images or videos published by the Foundation in a manner that falsely suggests endorsement, partnership, sponsorship, employment, or affiliation. Where wildlife photographs or videos depict sensitive locations or activities, users must not use them to facilitate disturbance, collection, trafficking, or other unlawful activities.

13. Intellectual Property Rights

Unless otherwise stated, the websites wildlifesurvival.org and indianturtles.org, and all content, materials, features, and resources made available through these websites, are protected by applicable copyright, trademark, design, database, and other intellectual property laws and are the intellectual property of Wildlife Survival Alliance Foundation India (WSAFI) or its respective licensors, contributors, or authorized partners.

This includes, without limitation, the names, logos, trademarks, service marks, and brand identities associated with Wildlife Survival Alliance (WSA), Indian Turtle Conservation Programme (ITCP), School in Aquatic Wildlife Biology and Conservation (SAWBC), and the KURMA application, together with all associated software, interfaces, content, graphics, databases, and digital resources. It also includes all text and written materials, photographs and videos, illustrations and graphics, reports and publications, educational resources, website design and layout, databases and datasets, maps and infographics, software, digital tools, training materials, course content, presentations, and other materials made available through the Website or associated platforms.

Nothing in these Terms grants you any ownership, licence, or other proprietary rights in any intellectual property belonging to WSAFI, WSA, ITCP, SAWBC, KURMA, or their respective licensors, except where expressly stated otherwise. Limited permission may be granted for personal, educational, academic, research, or non-commercial use where the relevant content expressly permits such use or where prior written permission has been obtained from WSAFI.

Any permitted reproduction, quotation, reference, or use of such materials must retain all applicable copyright, trademark, attribution, and proprietary notices and must not imply endorsement, sponsorship, partnership, certification, or affiliation with WSAFI, WSA, ITCP, SAWBC, or KURMA without prior written authorization.

The names Wildlife Survival Alliance Foundation India, Wildlife Survival Alliance (WSA), Indian Turtle Conservation Programme (ITCP), School in Aquatic Wildlife Biology and Conservation (SAWBC), and KURMA, together with their respective logos, marks, designs, programme identities, course materials, digital interfaces, and associated identifiers, may not be copied, reproduced, modified, registered, published, distributed, commercially exploited, or used in any manner that may cause confusion or suggest an unauthorized association with WSAFI without prior written permission.

The domains wildlifesurvival.org and indianturtles.org, including their respective website content, structure, design, databases, and digital resources, are also protected intellectual property of WSAFI or its authorized licensors and may not be reproduced, mirrored, copied, or commercially exploited without prior written permission.

14. Academic and Research Use

Information and publications available on the Website may be used for legitimate academic and research purposes, subject to applicable copyright and licensing requirements. Users must provide appropriate citations and acknowledgements when using Foundation publications, datasets, photographs, figures, maps, or other materials. No material may be presented as the user's original work when it has been obtained from the Foundation or another source. Commercial use, republication, redistribution, or substantial reproduction of research materials requires prior written permission unless otherwise expressly permitted.

15. Third-Party Websites and Services

The Website may contain links to external websites, social-media platforms, payment gateways, scientific resources, partner organizations, government websites, or other third-party services. The Foundation does not control and is not responsible for: Third-party content, Privacy policies, Security practices, Availability, Accuracy of information, Products or services offered by third parties. 16. Payment Gateways and External Service Providers

Certain services may be provided through third-party payment processors, hosting providers, communication services, analytics providers, form providers, or other service providers. Transactions conducted through such services may be governed by the third party's terms and conditions. The Foundation does not guarantee uninterrupted availability or error-free operation of third-party services.

Users acknowledge that they access the Website at their own risk and should take reasonable precautions, including maintaining appropriate security on their own devices. To the fullest extent permitted by law, WSAFI and its directors, officers, employees, consultants, researchers, volunteers, representatives, agents, affiliates, partners, licensors, and service providers shall not be liable for any direct, indirect, incidental, special, punitive, consequential, or other loss or damage arising from or relating to your use of, or inability to use, the Website or its services. This includes, without limitation, any loss or damage arising from errors or omissions in Website content, reliance on information provided through the Website, unauthorized access to or alteration of information or data, technical interruptions or failures, third-party websites or services, loss of data, loss of profits or revenue, loss of goodwill, business interruption, bodily injury, emotional distress, or any other consequential loss.

Any material, information, publication, dataset, software, application, photograph, document, or other resource accessed, downloaded, or otherwise obtained through the Website is obtained at the user's own discretion and risk. To the maximum extent permitted by applicable law, Wildlife Survival Alliance Foundation India and its directors, officers, employees, consultants, researchers, volunteers, representatives, affiliates, and partners shall not be liable for any direct, indirect, incidental, special, consequential, exemplary, or other damages arising from or relating to: i) Access to or use of the Website. ii) Inability to access or use the Website iii) Reliance upon information published on the Website iv) Loss or alteration of User Content v) Website interruptions or technical failures vi) Third-party websites or services vii) Unauthorized access or security incidents viii) Wildlife-related actions taken based on information available through the Website.

Nothing in these Terms excludes or limits liability to the extent such exclusion or limitation is prohibited by applicable law.

22. Indemnification

You agree to indemnify and hold harmless the Foundation, its directors, officers, employees, researchers, consultants, volunteers, representatives, and affiliates from claims, liabilities, losses, damages, costs, and expenses, including reasonable legal expenses, arising from or relating to i) Your violation of these Terms ii) Your unlawful use of the Website iii) Your User Content iv) Your violation of intellectual property or other third-party rights v) Your misuse of wildlife-related information vi) Your fraudulent or unauthorized activities.

23. Suspension and Termination

The Foundation may restrict, suspend, or terminate access to the Website or any feature where it reasonably believes that a user has: i) Violated these Terms ii) Engaged in unlawful activity iii) Misused the Website iv) Attempted to compromise Website security v)Submitted fraudulent information vi) Engaged in conduct that may harm wildlife, conservation activities, users, or the Foundation.

The Foundation may also suspend or discontinue Website features for operational, technical, legal, security, or organizational reasons. Termination shall not affect rights or obligations that accrued before termination.

24. Force Majeure

The Foundation shall not be responsible for any failure or delay caused by circumstances beyond its reasonable control, including natural disasters, floods, fires, epidemics, pandemics, extreme weather, governmental restrictions, civil unrest, war, cyberattacks, telecommunications failures, power failures, or failures of third-party service providers.

25. No Waiver

Failure by the Foundation to enforce any provision of these Terms shall not constitute a waiver of its right to enforce that provision or any other provision in the future.

26. Severability

If any provision of these Terms is determined to be unlawful, invalid, or unenforceable by a competent authority, that provision shall be modified or removed to the minimum extent necessary, and the remaining provisions shall continue in full force and effect.

27. Entire Agreement

These Terms, together with the Privacy Policy, Cookie Policy, Donation/Refund Policy, and any other applicable policies published on the Website, constitute the entire agreement between the user and the Foundation concerning use of the Website, unless otherwise expressly agreed in writing.

28. Governing Law

These Terms and your use of the Website shall be governed by and interpreted in accordance with the laws of the Republic of India, without regard to principles of conflict of laws.

29. Jurisdiction

Subject to applicable law, any dispute, claim, or controversy arising out of or relating to these Terms or use of the Website shall be subject to the jurisdiction of the competent courts at Lucknow, Uttar Pradesh, India.

30. Changes to the Website

The Foundation reserves the right, at any time and without prior notice, to: i) Modify or update the Website ii) Add or remove features iii) Change or discontinue programmes or services displayed on the Website iv) Update or remove content v) Restrict access to certain sections vi) Temporarily suspend the Website for maintenance or security purposes.

The Foundation shall not be liable for any consequences resulting from such changes to the extent permitted by law.
